The Scale of the Problem
The UK's post-war school building programme — particularly the CLASP (Consortium of Local Authorities Special Programme) prefabricated system used extensively from the 1950s to the 1970s — made widespread use of asbestos insulation board (AIB), asbestos cement, and sprayed asbestos coatings. These materials were cheap, fire-resistant, and thermally efficient. They were also, as we now know, extremely hazardous when disturbed.
The Department for Education's own data suggests that around 38,000 school buildings in England contain asbestos. The Joint Union Asbestos Committee (JUAC) — representing the major teaching unions — has campaigned for a programme of managed removal, arguing that the current "manage in situ" approach leaves pupils and staff at ongoing risk, particularly in ageing buildings where ACMs are deteriorating.

The duty applies regardless of whether asbestos is actually present; if there is reason to suspect it may be present, the duty holder must investigate.
The duty to manage requires the duty holder to:
- Take reasonable steps to find out if ACMs are present and where they are
- Presume materials contain asbestos unless there is strong evidence they do not
- Make and keep an up-to-date written record of the location and condition of ACMs (the asbestos register)
- Assess the risk of anyone being exposed to fibres from ACMs
- Prepare a written plan to manage that risk (the asbestos management plan)
- Take the steps needed to put the plan into action
- Review and monitor the plan and the ACMs
- Provide information on the location and condition of ACMs to anyone who is liable to work on or disturb them
Failure to comply with Regulation 4 is a criminal offence under the Health and Safety at Work etc. Act 1974. Penalties include unlimited fines and, for individuals, up to two years' imprisonment. Asbestos Surveys for Schools
Schools require different types of asbestos survey depending on the purpose. The two main types, defined in HSE guidance document HSG264, are:
Management Survey
(Formerly Type 2)

Refurbishment / Demolition Survey
(Formerly Type 3)

Asbestos Management Plans for Schools
Every school with ACMs present (or likely to be present) must have a written asbestos management plan. This is not optional — it is a legal requirement under Regulation 4 of CAR 2012. The plan must be kept up to date and made available to anyone who may disturb ACMs.
A school asbestos management plan should include:
- The asbestos register — location, type, condition, and risk score of every ACM
- The name of the duty holder and the competent person responsible for day-to-day management
- The management strategy for each ACM (monitor, encapsulate, or remove)
- A schedule of re-inspection surveys (typically every 6–12 months)
- Procedures for informing and briefing contractors before any work

Staff Training Requirements
Regulation 10 of CAR 2012 requires that all employees who are liable to be exposed to asbestos, or who supervise such employees, receive adequate information, instruction, and training. In a school context, this applies to a wider group than many duty holders realise.
Category A — Awareness
Who needs it:
All staff who may encounter asbestos in their work — including teachers, teaching assistants, and office staff in buildings with ACMs.

Category B — Non-licensed work
Who needs it:
Premises managers, site supervisors, and maintenance staff who carry out non-licensed asbestos work (e.g. minor repairs near ACMs).

Category C — Licensed work
Who needs it:
Licensed asbestos contractors only. Not applicable to school staff.

Briefing Contractors Before Work Begins
One of the most common causes of accidental asbestos disturbance in schools is contractors — builders, electricians, plumbers, decorators — working without being informed of the location of ACMs. The duty holder is legally required to provide this information before any work begins.
Best practice is to issue every contractor with a copy of the relevant section of the asbestos register for the area in which they will be working, and to require them to sign a contractor briefing form confirming they have read and understood it. Removal vs. Encapsulation in Schools
The decision between removal and encapsulation is one of the most important — and most misunderstood — aspects of asbestos management in schools. The HSE's guidance is clear: removal is not always the safest option. Disturbing intact, well-bonded ACMs during removal can release significantly more fibres than leaving them in place with a robust management programme.
When Encapsulation May Be Appropriate
- ACMs in good condition with no visible damage
- Materials in inaccessible locations (ceiling voids, service ducts)
- Where removal would cause greater disturbance
- As an interim measure while planning full removal
- ACMs with a low material risk score on the survey
When Removal Is Recommended
- ACMs that are deteriorating or damaged
- Materials in high-footfall areas subject to regular disturbance
- Areas undergoing refurbishment or demolition
- ACMs with a high material risk score on the survey

What to Do if Asbestos Is Accidentally Disturbed
Accidental asbestos disturbance in a school is a serious incident that requires an immediate, structured response. The school's asbestos management plan must include a written emergency procedure. If an incident occurs:
